TRANSFORMA Travel & Learn Program

Boston and New York 2024

The parties identified at the end of this agreement have agreed to enter into a service provision and liability contract which will be governed by the clauses set forth below:

FIRST CLAUSE: SUBJECT OF THE CONTRACT.

TES (TRANSFORMA Education Solutions) will provide the services detailed below for student participation in the program TRANSFORMA University Travel & Learn to be held between July 25 and August 2, 2024, in the cities of Boston, MA and New York, in the United States.

The services provided are as follows:

  1. Application process for the aforementioned program.
  2. Provide advice related to the program, documents required in the immigration process, travel insurance and vaccines needed for international students.
  3. Provide all the information requested by the student or their legal representative in order to successfully complete the application process for the TRANSFORMA University Travel & Learn program.
  4. Flight itinerary coordination with the student's school or group. If traveling alone, an itinerary that allows joining another group will be suggested, subject to availability.
  5. Provide guidance on program payment through the Square platform, PayPal, or a similar platform.
  6. Coordination in the destination country regarding the arrival and return of students to said program.

SECOND CLAUSE: CONTRACT VALIDITY.

This contract will remain in effect from the date of its signing until the return, the day on which the student enters the airport of his country of origin.

THIRD CLAUSE: SERVICES INCLUDED.

The program offered by TRANSFORMA Education Solutions includes:

  1. Airfare from the capital city of their country of origin to Boston (BOS) and/or New York and from there to the airport in their country of origin, with a maximum limit of USD 1,000.00. If the airfare exceeds the aforementioned amount, the student's parents or legal guardian will be responsible for paying the difference.
  2. Transfers between the airport and accommodation.
  3. Daily meals during the program. This includes 3 meals a day from the day you arrive at your destination until the day you return to your country of origin.
    1. Any extra food and drinks (snacks, desserts, refreshments, etc.) ordered during the program will be the sole responsibility of the participant. Special requests also include any student requirements outside the budget allocated for each meal included in the program. This plan does NOT include meals during layovers at airports within or outside the United States (outbound and return).
    2. In the event of a change in flight itinerary that results in the student's arrival or departure before or after the start or end dates of the program, meals will be the sole responsibility of the assistant. 
  4. Accommodation for the duration of the program. 
  5. Tickets to cultural and educational visits, locations detailed in the program.
  6. For every 10 students registered and paid, TRANSFORMA Education Solutions offers the school a full scholarship for a teacher or tutor traveling with the delegation. This scholarship includes items 1, 2, 3, 4, and 5 of this same point.

FOURTH CLAUSE:  PAY.

The cost of the program will be the sum of USD$3,895.00. The total payment must be made no later than June 30, 2024.

Participants must pay a reservation fee of USD 1,445,950.00 upon registration through the payment platform provided by TES. This fee is non-refundable under any circumstances. For more information, please read the cancellation policy. 

The program cost may be subject to change if the airfare exceeds USD 1,000. In this case, TES will add the difference to the total program cost.

This payment must be made through the Square, PayPal, or similar platform, or via direct deposit in US dollars to Transforma Education Solutions' Bank of America account in the United States. The latter is only applicable in exceptional cases.

FIFTH CLAUSE: DEFAULT OR DELAY IN PAYMENT.

In case of non-payment of the total amount of the program within the stipulated period, the student will not be able to take the trip, nor will TES make a refund of the amounts paid.

In the event that the student and/or their parents or guardians cancel the trip, the reservation money will not be refundable under any circumstances, but it may be transferable to another student or may be used as credit for a future trip organized by TES.

SIXTH CLAUSE: CANCELLATION POLICY.

  1. If the student and/or their parents or guardians cancel the trip up to 180 days before departure from the country of origin, TES will refund the 75% of the money paid (not including the reservationRegarding the paid reservation, this money can only be transferred to another participant or used as a deposit (reservation) for a future Transforma program. In both cases, it is the sole responsibility of the parent or guardian to communicate, within 30 days of canceling the original trip, which of these options they will exercise, indicating, in the respective case, the name of the participant to whom the money will be transferred and which Transforma program the reservation money will be assigned to.
  1. If the student and/or their parents or guardians cancel the trip between 179 and 90 days before departure from the country of origin, TES will refund the 50% amount paid (excluding the reservation fee). Regarding the reservation fee, this money can only be transferred to another participant or used as a deposit (reservation) for a future Transforma program. In either case, it is the sole responsibility of the parent or guardian to communicate, within 30 days of canceling the original trip, which of these options they will exercise, specifying the name of the participant to whom the money will be transferred and which Transforma program the reservation fee will be allocated to.
  1. If the student and/or their parents or guardians cancel the trip with 89 and 45 days before departure from the country of origin, TES will refund 25% of the money paid (excluding the reservation fee). Regarding the reservation fee, this money can only be transferred to another participant or used as a deposit (reservation) for a future Transforma program. In both cases, it is the sole responsibility of the parent or guardian to communicate, within 30 days of canceling the original trip, which of these options they will exercise, indicating, if applicable, the name of the participant to whom the money will be transferred and which Transforma program the reservation fee will be assigned to.
  1. If the student and/or their parents or guardians cancel the trip with 44 days or less before departure from the country of origin, There will be no refunds of the money paid. Regarding the reservation fee, this money can only be transferred to another participant or used as a deposit (reservation) for a future Transforma program. In both cases, it is the sole responsibility of the parent or guardian to communicate, within 30 days of canceling the original trip, which of these options they will exercise, indicating, if applicable, the name of the participant to whom the money will be transferred and which Transforma program the reservation fee will be allocated to.

In the event that any type of refund is applicable, it will be made through the Square, PayPal and/or similar system and the student, parents or guardians will be responsible for the cost of re-sending, taxes and fees associated with the return.

CLAUSE SEVENTH: DESCRIPTION OF THE TRANSFORMA TRAVEL & LEARN PROGRAM.

“TRANSFORMA Travel & Learn”This program is designed for high school students from South America who wish to experience a cultural and career-oriented journey in Boston and New York City. The emphasis is on understanding American culture and reflecting on the importance of discovering, clarifying, and creating a career plan that will allow them to make more informed decisions about their academic and professional future. The program begins on July 25th with the departure of the delegation from their home countries and ends on August 2nd, 2024. The program will include instruction and practical classes where participants will be given tools to create a life plan.

Cultural visits are also contemplated such as: Harvard University Campus, Harvard Art Museums, Museum of Science in Boston, JFK Presidential Library, Statue of Liberty, Museum of Immigration – Ellis Island, 9/11 Memorial, Times Square, and Museum of Natural History. TRANSFORMA Education Solutions The right is reserved to replace cultural and recreational activities with others of equal or similar quality, depending on availability. 

EIGHTH CLAUSE: STUDENT OBLIGATIONS.

  1. Act truthfully and diligently by providing the information required for the application of the program.
  2. Attend to the requests and recommendations made by the advisor.
  3. Make the payment for the TRANSFORMA Travel & Learn program in the manner and on the dates indicated.
  4. Comply with and respect the rules and regulations established by the accommodation and cultural visits while the program is taking place.
  5. Take care of the accommodation facilities during the program. Any damage caused, and consequently, the repair, payment, and replacement, will be the sole responsibility of the student and/or their legal representative.
  6. The student is solely responsible for the care of personal and/or technological items brought on the trip. TRANSFORMA Education Solutions does not cover costs for loss or theft on or off campus or at any locations we visit.
  7. All participants in this program must have travel and health insurance that covers the entire duration of the trip, from the day they depart from their country of origin until the day they return. 
  8. It is the responsibility of each student to have a valid passport and tourist visa (ESTA or B1-B2) to travel to the United States. A digital copy of each of these documents must be provided to TES at least two months prior to travel.
  9. All students under 18 years of age must have a notarized travel authorization from their parents or guardians for international travel to the United States. A duplicate of this authorization is required. It is recommended to make both physical and digital copies for backup purposes.
  10. Students must strictly adhere to all schedules established in the program, including departure times, meetings, meals, arrival times, bedtime, and any other instructions given by the trip leader(s). Students must also respect the designated areas for visits to the various tourist attractions. Under no circumstances may students leave the designated areas without the group leader's permission.
  11. Respect the leaders and those in charge of the outreach program, obeying and following their instructions to the letter to ensure a better experience for the delegation. At the same time, the student should treat other program participants with courtesy.
  12. No alcohol or tobacco is allowed. The use of these substances is strictly prohibited during this trip. United States law prohibits and punishes the use of these substances by minors. For this purpose, a minor is defined as 21 years of age. Violating this law and its consequences is the sole responsibility of the school, student, and/or their legal guardian.
  13. Take care of the buses, vans, and/or other means of transport used by the delegation during the program. Any damage caused, and consequently, the repair, payment, and replacement, will be the sole responsibility of the school, student, and/or their legal representative.

NINTH CLAUSE: OBLIGATIONS OF PARENTS AND/OR GUARDIANS OF THE STUDENT.

The obligations of the student's parents and/or guardians will be the following:

  1. Ensure that the student meets all legal and administrative requirements to be part of the TRANSFORMA Travel & Learn program.
  2. Act truthfully and diligently by providing the information required for the application of the program.
  3. Attend to the requests and recommendations made by the advisor.
  4. Make the payment for the TRANSFORMA Travel & Learn program in the manner and on the dates indicated. No student will be allowed to travel if they have not made the full payment for the program 30 days before the program start date.
  5. Any damage caused by the student during their stay and participation in the program, and consequently, the repair, payment and replacement will be the sole responsibility of the student and their parents or guardians.
  6. Provide TES with proof of the student's travel and health insurance contract 30 days prior to departure from the country of origin.
  7. Ensure your student has a valid passport. A digital copy of each passport must be provided to TES at least two months prior to travel.
  8. Apply for your tourist visa (ESTA or B1-B2) to travel to the United States in a timely manner. You must provide TES with a digital copy of each visa at least two months prior to your trip.
  9. Provide a notarized travel authorization for minor students traveling to the United States. A duplicate of this authorization is required. It is recommended to make both physical and digital copies for backup.
  10. Any damage caused by the student to buses, vans and/or means of transport in which the delegation will travel during the course of the program, and consequently, the repair, payment and replacement will be the complete responsibility of the student and their parents or guardians.
  11. Each student will be responsible for obtaining the required travel information and documentation to be presented at the airport of origin, covering personal costs for visas, vaccines, notarized permits, taxes, and everything else required by airport and government entities in the country of origin and destination.

CLAUSE TEN: PROCEDURE IN CASE OF FAILURE TO COMPLY WITH RESPONSIBILITIES AND DUTIES.

If the above points are not respected, the school and the parent or guardian authorize TRANSFORMA Education Solutions and, consequently, the program leader to proceed as follows:

  • First Step: Verbal warning or admonition.
  • Second Step: Notification to parents or guardians.
  • Third Step: Exclusion of the offending student from the remaining activities, without refund.

If necessary, the parents or legal guardians will be asked to pay for the student's return ticket in advance. TRANSFORMA Education Solutions, and therefore its legal representative, will not be responsible for costs associated with the student's absence, nor for expenses incurred due to their early return home. See this in relation to the following clause.

ELEVENTH CLAUSE: ADVISOR'S OBLIGATIONS.

The advisor undertakes to fulfill all the responsibilities described in the first clause indicated as the object of the advice.

TWELFTH CLAUSE: COVID SECTION.

In the event of restrictions imposed by local, national, or international governments that prevent the trip from taking place on the scheduled date, the student may request that TES postpone or reschedule the date. The student, their parents, and/or legal guardian will be responsible for any costs associated with fare changes, cancellations, or taxes related to this postponement within the first 30 days following the departure date. If the student does not submit this request in writing via email within the aforementioned timeframe, it will be understood that they waive their right to a credit for the canceled trip. 

THIRTEENTH CLAUSE: AUTHORIZATION FOR MEDICAL PROCEDURES.

I understand that TRANSFORMA Education Solutions will not have medical personnel available while the Student is participating in the program. I expressly agree and consent that TRANSFORMA Education Solutions, including but not limited to all its staff members and program administrators, is authorized to approve emergency medical treatment for the student, if deemed necessary in their judgment, including hospitalization, medical and dental care, and that all actions taken in this regard are subject to this agreement.

Furthermore, I understand and accept that TRANSFORMA Education Solutions assumes no responsibility for any injury or damage that may arise from or in connection with such authorized emergency medical treatment.

In the event that a student requires hospitalization due to any accident or illness, including COVID-19, TES is not responsible for the resulting costs. These are the sole responsibility of the student and/or their legal representative.

FOURTEENTH CLAUSE: RELEASE OF LIABILITY.

The Student and their legal representative hereby release TRANSFORMA Education Solutions and its legal representative from all liability for illness, accident, death, loss of luggage, loss, changes or delays in flights, national and international connections, loss of personal documents, loss or theft of personal items or any other unforeseen event occurring during their stay at accommodations, cultural visits and during the journey to and from their country of origin to the cities of Boston and New York, and back to their country of origin.

TRANSFORMA Education Solutions is not responsible for the failure to meet the personal expectations of the student or their representative.

FIFTEENTH CLAUSE: PROGRAM CANCELLATION.

A minimum of 40 participants is required for the provision of services and development of the program offered.

In the event that the Boston and New York program is cancelled due to insufficient participants, those registered and paid on time will be included in the next program developed by TES, the date of which will be announced in due course, and the money paid will be credited to their account.

SIXTEENTH CLAUSE: COPIES.

This contract is signed in two copies, one remaining in the possession of TRANSFORMA Education Solutions and the other in the possession of the other contracting party.
